Aggressive Driving Laws in Arizona
Under Arizona law (A.R.S. 28-695), a person commits aggressive driving if they are ticketed for speeding and commits at least two of the following:
- Failing to obey traffic lights
- Passing another vehicle on the right by leaving the roadway
- Unsafe lane changes
- Following another vehicle too closely
- Failing to yield the right-of-way as required by law
- Their driving creates an immediate hazard to another person or vehicle
Penalties for Aggressive Driving
A first offense will likely be classified as a Class 1 misdemeanor, with consequences including the requirement to attend and complete a state-run traffic school and the suspension of driving privileges for 30 days.
If a repeat offense happens within 24 months of the original conviction, defendants face another Class 1 misdemeanor charge, this time with the possibility of having their driver’s license revoked for as long as one year.
Possible Defenses Against Aggressive Driving Charges
- Challenging the officer’s observations: I might point out inconsistencies or errors in the officer’s account of the incident. Witness statements or video recordings might be used to contradict their version of events.
- Proving necessity: I may argue that your actions were necessary to prevent immediate harm or due to an uncontrollable emergency. This could include situations like swerving to avoid an accident or speeding to get to a hospital in a dire situation.
- Lack of intent: Related to proving necessity, I might show that you had no intention to drive aggressively. Intent is a key element in criminal cases, and lack of it may reduce liability or penalties.
- Mechanical failure: A malfunction in your vehicle may explain actions like speeding, lane deviations, or other driving irregularities. For example, faulty brakes or steering issues could make it impossible to maintain proper control of the car.
- Constitutional violations: If law enforcement violated your rights during the traffic stop or investigation, this could form the basis of your defense. Examples include a lack of reasonable suspicion to stop you or conducting an unlawful search.
