AGGRAVATED DUI | WRONG-WAY DRIVING
Driving while impaired (DUI) and traveling the wrong direction on a highway is the most recent addition to Arizona’s felony DUI laws.
In 2020, the Arizona legislature added to the state’s felony DUI statute. Now, an Aggravated DUI can be committed, pursuant A.R.S. § 28-1383, when a person is driving the wrong way on a highway.
The statute has its flaws. The government has attempted to extended the definition of a highway to any street. Howver, the legislative history of the law plainly shows it was only intended to apply of situation on freeways.
